The buyer doesn't bear more risk than they do now. Its not like they are forced to take the medicine if you remove the punishments for taking it. I'm just saying don't punish the buyer on top of having them bear the risk. There really isn't anything "wild west about that". It wouldn't be people trying drugs at random or doing crazy experiments with drugs with unknown effects. Most drugs sales would be of drugs that current are or will be approved if we keep the current system. Insurance companies probably won't pay for drugs without trials for safety and effectiveness. Pharmacies might not even carry drugs that haven't been approved in some way. People would have to seek out these drugs, and if for no other reason than than fear of lawsuits there likely would be a serious informed consent procedure And (Also the "wild west" wasn't really as wild or as dangerous as many seem to assume, but I figure you mean that in the figurative sense based on the common perception of the wild west)

The FDA has an incentive to not approve. If they don't approve, or delay approval and there is no problem with the drug, they don't take as hard of hit as if they approve and than there is a problem.

Also often even when there is a problem that might be enough to stop approval, the drug might be worthwhile for some people anyway. Mostly for those with terminal or potentially terminal conditions, but in some cases it might make sense for others as well.
