It isn't clear exactly what they planned to do with the phones. Regardless, it is a felony to even try.

If the prosecutor is serious about the case, he'd be nuts not to get the unedited tapes and show that O'Keefe and crew are not journalists, but propagandists. Investigative journalism often walks a fine line with the law. But, because they are trying to inform, they can catch a little slack. Someone with a track record of producing propaganda isn't going to get that slack.

The wingnuts will scream. But they always do when their people get caught. Laws are just for the little people, not the elite.
