Legally, even just asportation (moving something from one place to another, e.g., putting an item in your pocket without leaving the store) is punishable as larceny in Virginia. Next time ask for them to put the lobster butter in a little package for you. I am sure you're a very nice lady, and have no idea what it feels like to be treated as a common criminal, so hope I am not hurting your feelings.

I once represented an indigent who served 30 days for taking a newspaper from a convenience store. He did it in the Town of Herndon, which only has trials once a month, and I was court appointed to represented him, so got him out the day after I was appointed, but the red tape to appoint a lawyer took a month!

Back to Berger. Secreting the items in his clothing is probably illegal in and of itself, much more leaving with them, much more discarding them.
