FTC Clears 3G Cell Phone Patent Fees Of Antitrust Worries

TOKYO (Nikkei)--The Fair Trade Commission on Thursday informed 19 major telecommunications companies around the world preparing third generation cell phone services that their plan for standardized patent fees conflicts in no way with antimonopoly law.

NTT DoCoMo Inc. (9437), Fujitsu Ltd. (6702), France Telecom and 16 other companies are planning to standardize patent royalties worldwide, raising suspicions that such collaboration constituted the action of a cartel.

The FTC decided otherwise, arguing equipment manufacturers and other companies can join the group at will, and royalties are set at a maximum of 5%.

The advanced service will be introduced in Japan ahead of Europe or the U.S., meaning this is the first time Japanese competition policy authorities have made an important ruling before their counterparts in Europe and the U.S.
