1031 exchange, Starker decision. The legislative congress never could deal with that one, so the courts made decisions and refinements and it sort of ended up like don't ask don't tell. 1031 exchanges go unchallenged by the congress (because they are moribund),or the courts (because it has sort of become"established law"), yet the congress should rightfully be writing the law. Lots of grey areas in the law (can you force a sitting president to appear in court for a minor, or dubious legal claim?) where the courts have to lead the way. No frigggen way congress cna do it. Too encumbered with partison politics. When the congress cannot keep up with cultrual evolution, like racism, the courts step in. And rightfully so!
