From what I understand this latest legal debate is immaterial to BIOM, Therotope etc.. In fact if anything it is good for BIOM since it demonstrates their willingness to protect their intellectual property and in the end I would venture to say that the suit will add to BIOM's bottom line if they win a judgement in their favor. I guess we will have to wait a while on this one.
