you're right; but bottom line is that Broadcomm could end up losing the whole kit and kaboodle if the PTO invalidates the patent. Might be cheaper than developing a software fix to avoid it. Besides, it reminds those challenging Qcom that they can lose a lot by alleging patent infringement. Whatever, the case, Broadcomm is in worse position today.
