Yes its unfortunate that the dog was killed, but there seems to be a fairly clear argument for self defense. Making the person pay the price for the dog because he defended himself doesn't sound reasonable (although if he could pay and avoid any other possible penalty and avoid the legal costs it would make sense as a practical matter), but charging him with a felony that could in theory result in up to 5 years in prison and a $10K fine (on top of the $11k they want him to pay for compensation, even though a third party is donating a replacement dog), is really unreasonable.
