When establishing royalty rates for IPR why not just let the value of the patent establish its rate. When a patent is submitted for consideration to be incorporated into a standard the submitting company proposes a royalty rate for the patent. If the rate is exorbitant and there are adequate workarounds one of the workarounds at a better rate can be selected. This would keep patent pricing competitive and if some IPR is a unique solution it can be appropriately valued. If a company or companies don't like a proposed patent's rate and there is no workaround then they can negotiate or opt out of the standard. A free market solution establish the need for and value of patents instead of political gamesmanship.
