Why do you bother? IMO, just move on. Unless you gonna get a law degree and specialize in this particular branch of law, you won't get an answer that satisfies you. And the non-lawyer answers are worthless, since they are all based either on sentiment or on "common sense", which is not how lawsuits are won/lost.

Disclosure: I have a position in FNM/FRE prefs. I have low confidence that lawsuits will prevail and I would not advise anyone to buy here.
