I don't think that this criminal law affects SI posters who are not trying to manipulate the price of a stock. Like most criminal laws, it requires criminal intent -- in this case a desire to post "for purposes of commercial advantage or private financial
gain," which would be absent on this thread, for example. I can think of other situations in which the law could be applied to posters , such as pump and dump artists or short sellers. Even those cases would be very hard to make.

I wouldn't worry too much about the FBI coming after you. They always need a warrant (i.e., they always need to persuade a judge that they have a reason to look). What's going on is they are trying to avoid having messages sent which are impossible to search, even after getting a search warrant. There are vanishingly few search warrants issued in comparison to messages sent in commerce, and none would be issued for the FBI to look just for the hell of it. And they have nowhere near the resources or desire to turn us into a police state.
