If you are suggesting that RIAA's failure to "pursue" XM might result in sales approaching those of the IPod, I would say it is well worth XM's effort to fight it.

No more than are you. If XM determines this capability can enhance future opportunities in a material way, I'm sure they'll fight it, and when it is over they'll win.

Dude.

RIAA "purusing" it doesn't mean they'll win it. If it is based on the current law, they won't (although, it would undoubtedly have to be appealed before we would know).

It is important to remember that this was merely a ruling on XM's request that the suit be dismissed without a hearing. It is not tantamount to losing the case.
