Going to the patent office first is irrelevant (in this country), inventing first is what is relevant. It also saves the industry a lot of R&D money. INTC promulgated standards for SDRAM which were based to a great extent on the effort and investment of Rambus. The industry did not have to go through the problems Micron had with EDO-DRAM, (and Micron is still trying to recover this investment). If a company is in the business of taking out the risk of R&D for other companies, believe me, they would love to pay royalties.

I know of one company that has spent over the last 15 years more than $25 MM on a technology, for naught. Now they are negotiating a license, the upfront fee might be around a Million and the royalties rate, maybe 5%, I have calculated that the present value of all future royalties will be much less than the $25 MM, and furthermore, those $25 MM would have grown to between $50 to $75 MM by now. Smart companies are learning to "outsource", very smart companies are learning to outsource intellectual property.
