I had assumed if the first buildout deadline of 1/03/02 was not met, the licenses would be forfeited, and the second deadline would be moot.

All of the C Block build out deadlines expire Jan. 03, 2002. According to the licenses on the WTB web site.

The license term is 10 years from date of issue.. So they expire on Jan. 03, 2006.. The basis for renewal are as follows:

PART 24--PERSONAL COMMUNICATIONS SERVICES--Table of Contents

Subpart B--Applications and Licenses

Sec. 24.16 Criteria for comparative renewal proceedings.

A renewal applicant involved in a comparative renewal proceeding
shall receive a preference, commonly referred to as a renewal expectancy, which is the most important comparative factor to be considered in the proceeding, if its past record for the relevant license period demonstrates that the renewal applicant:
(a) Has provided ``substantial'' service during its past license term. ``Substantial'' service is defined as service which is sound, favorable, and substantially above a level of mediocre service which might just minimally warrant renewal; and
(b) Has substantially complied with applicable Commission rules, policies and the Communications Act.

Under 47CFR24.103 Construction requirements.

(h) Failure by a licensee to meet the above construction requirements shall result in forfeiture of the license and ineligibility to regain it.

Here is a page with the FCC Section 24 Rules and Regs.

I agree with the Consumers Union statement.. Let's take it to the Supreme Court.

Someday.. The FCC will wake up and figure out that the Major Wireless Service Providers Verizon, AT&T, Sprint, Alltel, Cingular (aka BellSouth, SBC). Have no interest in providing a vechicle that induces competition with the Major LEC Carriers like Verizon, AT&T, Sprint, Alltel, BellSouth, SBC. Hey!! Aren't those the same guys?

Companies like LWIN are the biggest threats to these companies Wireline/Wireless Empires.
