Essentially the dissent said, you still can have the recount with standards which satisfy the equal protection clause, and you don't have to worry about the December 12 deadline or the December 18 deadline, do what Hawaii did in 1960 and send two slates of electors to Congress and let Congress decide which is the correct slate. However, in 1960 Hawaii also elected a new governor, so there was one slate which was endorsed by the old, Republican governor, and one slate which was endorsed by the new, Democrat governor. In this case the only slate which would be endorsed by the governor would be endorsed by Jeb Bush.

Gore's legal team obviously had to game this all night to see if there was any way around Jeb Bush. Some probably argued that "signed by the executive" could mean anyone in the Executive Branch, so the Democrat Attorney General could endorse Gore's Electors. But what was the chance that the Republican House would agree with that? Zip.

We already gamed all this on this thread. All the final arbiters in the process are Republicans. No way out.
