Believe it or not, yes. The venture community is not as careful about scams as most people would think. And the venture leasing people are very quick to make deals with little due diligence. It is very competitive and they are under great pressure to do a lot of deals quickly. Usually, they rely on having credible VC's in the deal instead of careful due diligence. And, the basic premise of their business is that they can always resell the leased products if the deal goes south so they don't worry very much about it. The occasional big hit they get from the warrants more than makes up for the remarketing discounts on their bad deals. More than likely, the CYOE investment in Crescent gave them all the perceived safety they needed.

I am not familiar with NASDAQ's methods, but I will quess. I would bet they are in contact with Comdisco, who is currently trying to sort out this mess, and they probably did send all that money. So, Comdisco is probably conducting the investigation with NASDAQ waiting on the results. If Comdisco admits they were conned, the game is over for CYOE. If Comdisco says everything is OK, NASDAQ steps back.

Again, I have experience with Comdisco, but this is all just speculation. Still, I like my short and made a side bet with my partner that CYOE will never trade again.
