Apparently those analysts don`t understand that binding arbitration, pursuant to a contractual arbitration clause, is not voluntary, and has nothing to do with concepts of mediation, facilitation, or other negotiating tools.
And as for Ericsson`s noble concern for royalties, and there affect on WCDMA adoption, they settled with Qualcomm after the Markman Hearing in 1999, and cannot collaterally attack the court sanctioned deal that they struck. Their altruism is both disingenuous, and a veil over their avarice and greed.
