Nokia claims that the royalty paid is no more than 3% while QCOM stated to be 3% or more. Since the agreement is confidential, is the royalty rate is based on percentage and capped by dollar amount? Let us take the case of Apple I-phone which will be selling around $ 500 each. Will the percentage remain the same? I don't think QCOM's website indicates a maximum dollar amount. I believe you smartly address this issue by an example of expanding a phone into some vehicle which presumably be selling for thousands of dollars. If we were at other side, would we be willing to pay percentage with no ceiling? Is this the crux of the disagreement between NOK and QCOM?
