He was subject to recall to active duty with no notice. And as an officer who had not yet been discharged he was still subject to UCMJ charges for anything he did in Nam or anywhere else.

The issue in my mind concerns his activities meeting with North Vietnamese governmental officials in Paris. That comes dangerously close to a private citizen engaging/interfering with foreign policy. The fact that he was an officer in the U.S. Military who had not yet been dischaged makes it that much more serious.

To put it in context, imagine a junior officer who fought in Iraq coming home, leaving active duty, then heading to the Middle East to meet with Iranian officials? It's not an exact parallel, but close.
