What do you mean by rights?

"Natural rights", legal rights clearly granted by law or treaty (which may or may not be natural rights, or some argument or claim that they would have rights under law or treaty.

Prisoners in WWII where kept on our soil. There should be no problem with doing so now, but practically there might be because of what the courts might do, or because of political reactions.

I noticed you didn't answer my question.

Should we have applied that full range of legal rights to soldiers, and spies captured in WWII? Should they have had full jury trials, full disclosure requirements, the requirement that they be proven guilty beyond all reasonable doubt, and multiple appeals. If at any point we couldn't meet those requirements should we have released those enemy agents?

Or to put it a different way, would we be morally required, or required by the Geneva convention or other law or treaty, to release the vast majority of captured nazi agents, or agents of the military regime that ruled Japan during WWII?
