Your an enemy combatant, if your a combatant on the enemy side. Its not a vague definition.

The issue isn't a definitional one. Its determining if someone fits the fairly simple definition, when they are trying to hide what they are. In some cases there is a simple readily apparent criteria. They where attacking American forces. In other cases it is harder to tell, but its just as hard or harder for the courts, esp. since most of them are already overloaded with cases. In any case the normal standards that would be applied in an American court are unreasonable for this circumstance, and have never been applied in the past.

Now the fact that something hasn't been done before is hardly strong evidence that its a bad idea, but you where presenting your ideas as if they where a return to normal standards and they are not.
