The first Palm Beach County case to reach a
judge got off to a jarring start as Boca Raton
voter Milton Miller voluntarily dismissed his
lawsuit hours after it was filed at federal court
in West Palm Beach on Thursday. A shouting
spectator was escorted out of the courtroom.

Attorney Lawrence Navarro dropped Miller's
case at a brief hearing, saying afterward that
he had received calls from people he refused to
identify asking his client to dismiss the lawsuit
seeking a new election.

``Al Gore is going to step up and fight this
battle,'' Navarro said without elaboration.

The federal suit in Tallahassee was filed on
behalf of a black Tampa man who said he was
turned away from the polls for lacking a driver's
license.

Judges will be guided by a 1997 state
Supreme Court decision in a Volusia County
election in which county elections workers
were found to have broken state law 14 times
and committed gross negligence in handling
absentee ballots, but did not result in a new
election.
