I guess the reverse isn't true. Else the IRS would have a boatload of problems with Lucent.

EDIT

That is to say, if one owned Lucent at 80, say, then the logic is that it is "substantially worthless" and so you should get the tax loss carryforward. They should force someone who loses that kind of money to do that.

Nah, it only works if you make money; of that I'm certain.
