The Constitution says only Congress has the right to declare war. The Constitution says the National Guard is to be used to repel INVASIONS. The Constitution ""guarantees the right of the people to be secure in their persons, houses papers and effects against unreasonable searches and seizures, shall not be violated" without a warrant to do so. (I believe the internet is covered under this amendment) The Constitution says that unless someone is currently in the military, he shall not be held unless indicted by a Grand Jury.

What the president must swear to upon taking the oath of office is "I do solemnly swear that I will faithfully execute the Office of President of the United States and will to the best of my ability, preserve, protect and defend the Constitution of the United States".
