I think I hit the nail on the head. Infineon withheld the 'smoking gun' documents until they
new they weren't going to get the case thrown out on summary judgment. Now they have
a pissed off judge, pissed off lawyers, and two other sets of litigants besides themselves
with only one leg left to stand on, and it's broken.
