maybe just as aapl made those of us who early adapted the iphone semi-whole with the $100 rebate, it's trying to help T with this software update.

i do think aapl can make a software patch that prevents use with another carrier.

since there will be other phones, hopefully faster 3g or better, it's time to move on from iphone 1x

as aapl investor, i feel this move cannot be bad and like you, feels it is more marketing than anything.

I don't think there's that much tough and effort into breaking unlocked phones. The warning shot is simply announcing their policy and if they discover they're supporting tampered phones, they'll be able to recoup some of those costs (either by denying warranty service and/or charging for the repair). The big problem comes with proving that the unit has been tampered, especially if it's brought in by the purchaser. I think they'll ignore the technical aspects unless there's clear evidence (don't want to really piss off an innocent customer and be WRONG). But if you bought it off a 3rd party, and then they can send you back to the guys who sold it to you. Right now I believe the only authorized dealers are still Apple and ATT.

As far as the update, it's time for a fix. I'm surprised that some fixes haven't already been done over the air. Maybe they've been minor, and not worth advertising and this is a medium sized release. With the new iPod Classic I just got, it came loaded with firmware 1.0 and as soon as I connected, firmware 1.0.1 was available and updated.

BTW, besides the excellent discussion, I think folks here have been doing a great job in helping pump up Apples next quarter results! The should beat estimates handily.
