This is certainly what the more conservative among us would have us think. If they can't win the argument that it's unconstitutional, they'll try to win the argument that it's impolitic. As for whether it's true, it's rather obviously too early to tell anything.

Rosen is an odd bird. Good mind but frequently pushes it to odd conclusions. I'll have to read this one later this morning to see what he does with the argument.
