We can use the term "nanny state" derisively, but sometimes it's smart defense against predatory industry.
Let's get one thing straight. The soft drink industry is NOT a "predatory industry."

If I feel like having a 32oz drink, I want to get a 32oz drink, not two 16oz drinks. Kind of stupid to have to do that if, for example, I want to watch a long movie like The Hobbit and there is only one cupholder available to me.

Frappacinos from Starbucks have lots of calories. Why not ban them as well?

This is not a "smart defense."
