I expect that there is at least one state in which the CBS Broadcast reached in which Killian's widow or son could sue for defamation, or as you note, theft (or receipt of stolen property). Just enough to get a colorable suit in which you could then undertake discovery and information about the source of the documents, and see the actual copies CBS has.

I'm surprised that one of the conservative legal groups hasn't jumped on this yet.
