You're talking about ERISA preemption and he's talking about limited jurisdiction arising from the purchasing of insurance in a state from a carrier in another state.

The notion of a purchase across state lines has nothing to do with ERISA. The issues are separate and depend on whether the insurance is part of an employee welfare benefit plan.

One deals with personal jurisdiction, the other with subject matter jurisdiction.

Evidently these are not issues you have actually addressed in practice.
