With Bush on a high rating, I wonder how the Supreme Court versus the President would go. Most of the Supreme Court are Republican presidential appointees, so they'd lean in his favour. But if they are inclined more to the legal view as expressed by other courts, I think they wouldn't lean too far to the state as preferred creditor.

There's always presidential impeachment if the Supreme Court hands down a verdict and the president defies them.

What a lot of fun this could be.

Of course it would never come to that, but power-trippers love their power [see Mugabe] and a very loathe to give it up to usurpers.

My guess is that the Supreme Court decided to hear the case because it's really big-deal in dollar value, has got Congressional noses in knots, it's of large-scale public interest [cellphones are big deal], spectrum is government property which is being leased in a complicated agreement, including forfeiture clauses as you have pointed out and as did Senator Hollings, there are implications for other FCC activities. It's got the makings of a lot of fun and huffing and puffing by big cheeses.

It's not surprising the Supreme Court would hear it.

It's a lot more fun that revisiting Roe vs Wade.

There's also the fact that spectrum is the carrier for It and the relationship between It, the state and the individuals not to mention people and governments around the world. The Supreme Court would want to have a say in that. This is the biggest thing ever!! There's no show without Punch, so here come the lawyers and the Judiciary.
