McMinn County (WBIR) - A Tennessee man was shot and killed by his wife last Saturday within 15 minutes of his release from jail. The man was arrested earlier in the day after police arrived on the scene at the Athens Super 8 Motel, responding to a report that Robert Vann Marshall, 34, was suicidal, armed and threatening to kill his wife and children. Marshall was apprehended at the scene with narcotics and a handgun on his person. Officers also discovered an active order of protection against him. They arrested him on charges of narcotics and firearms, and transported him to the McMinn County Justice Center, where they explained the order of protection. Marshall was ordered to not contact his wife or go to their residence.

He was released at 1:27 p.m
after making bond.

At about 1:38 p.m., 9
11 received a call from Melissa Marshall, claiming that her husband was attempting to get inside their home. With police on the way, she told dispatchers that Robert Marshall had forced his way inside and that she had shot him. When police arrived at the Marshall residence, they found the front door kicked in and Robert Marshall in a back bedroom with a fatal gunshot to his chest.

Thus far, no charges have been filed against Melissa Marshall. However, the Attorney General's office has requested an autopsy and the investigation is ongoing.

Sheriff Joe Guy said detectives processed the scene but no charges were filed against Melissa Marshall because it appeared to be a case of self-defense. He also said they will work with the District Attorney Generals office to decide whether or not to present it to a Grand Jury.
