Different states have different setups. I haven't really looked in to MD. Maybe that certification systems helps, or maybe it doesn't, its hard to say without direct experience with it or research in to it, I can't know how easy it is to get a doctor to certify malpractice in frivolous or at least questionable but non-frivolous cases. In court cases lawyers find experts to say all sorts of things, a certification not under oath or in court may be easier to get. Also not every state has such a restriction.
