VANCOUVER, B.C., Nov 27, 2000 (BUSINESS:URL.), has filed a Writ of Summons and Statement of Claim in the Supreme Court of British Columbia against Intravelnet.com Inc. ("Intravelnet.com), Dan Clozza (President and Director of Intravelnet.com) and David Owen (Secretary, Director of Intravelnet.com).
The Company is responding to actions and statements made by Intravelnet.com, its President, Dan Clozza, and its Secretary, David Owen. The Company has claimed damages and slander against Mr. Clozza and Intravelnet.com for statements made in a November 10, 2000 article that appeared over PR Newswire via COMTEX, for breach of fiduciary duty and breach of duty of good faith and fair dealing by Mr. Owen, and breach of confidence by Mr. Owen, Intravelnet.net and Mr. Clozza.
The Company is pursuing a claim against the Defendants that includes:
- An interlocutory and permanent injunction restraining the Defendants from directly or indirectly using, copying, selling, mortgaging, pledging, transferring, assigning, tampering, or disposing of or dealing with or disclosing to any third party secret, proprietary or confidential information, knowledge, or data of the Plaintiffs, whether or not obtained, acquired, or developed by the Defendant Owen, such information to include but not be limited to the hybrid multicast international network;
- An interlocutory and permanent injunction restraining the Defendant's from publishing or causing to be published any words disparaging of the Plaintiff's proprietary or confidential information;
- An Order that the Defendants return to the Plaintiff all secret, proprietary or confidential information, knowledge or data of the Plaintiffs, whether or not obtained, acquired or developed by the Defendant Owen, which Defendants have in their possession or control to the Plaintiff;
- General, Specific, Punitive, Aggravated Exemplary damages;
- Interest Pursuant to the Court Order Interest Act;
- Costs and other relief deemed just.
