That is not exactly what Benford's law states. I am not sure of the statistics of your example.

For real voting the first digit of the votes for each candidate will be a 1, 30.1% of the time.

For desperate in the middle of the night ballot filling out, the first digit will not be a 1, 30.1% of the time. Stated in the reverse order, if the first digit is not a 1, 30.1% of the time the votes are not real and were probably generated by fraud.
