With regard to IBM contracting process, it was driven by earlier consent decree. They licensed the OS, I believe, by virtue of their business model that was heavily influenced by that decree. There are some interesting books on IBM that you might be interested in. Watson, is one that comes to mind right off hand. But there are others.

In any event, Bill Gates has taken magnificent advantage of the opportunity that this presented. And congratulations to him for siezing that opportunity and running with it.

But at this point, driving other companies out of business, or to insignificance, through the use of a monopoly position is precisely what the laws were intended to address. And in fact it does benefit US to stop this practice. We have all benefit from innovation and competition.

I happen to think that the DOJ is moving toward an injunction, as this fine seems a reasonable first step in a progression. Interesting that Japan and Europe seem to be making parallel steps, as well. This may also be the only thing that MSFT understands, because 1M a day isn't a lot for a company doing over 1B a month.

Separation between OS and Apps may make a difference. If there was no incentive to push one browser, because it's not yours, then maybe we wouldn't be seeing this situation arise. If it still had then it would be even clearer.
