The Economist Magazine has a piece about QCOM in the latest issue and, in it, the author argues that QCOM's extremely aggressive stance re its patents may well spawn increased efforts to get around them. Your post suggests that may be happening.

OT Speaking of patents, there is a piece in the Financial Times about a British Telecom US patent on hyperlinks. The patent is 14 years old and BT has just announced they will enforce it and seek royalties from people using hyperlinks on the internet. Sounds crazy but, if Amazon can patent "one-click" ordering, then anything's possible.
