You are mixing apples and oranges in your rebuttal.

Yes, any person has the right to defend, to the best of their ability, their life and those of their family's.

However, many capital murder cases are tried with no eye witnesses to the crime. A suspect is chosen and indicted on the basis of circumstantial evidence. Sometimes that evidence is manufactured for expediency -- or worse, political gain.

Oftimes, especially if the defendant is poor, appointed council performs poorly in court, while the DA or Assistant DA has all the money and resources of the State behind him/her.

Many were executed in the South between 1900 and 1930 simply because of the color of their skin.

I would not like to go on trial for my life in this country knowing I am innocent. Knowing my temperament and inherent sarcasm, the jury would be sure to convict me and the judge sentence me to death. And what would my crime be? Sarcasm? Obviously a crime punishable by death, heh?
