03/01/10 - U.S. Dataworks to appeal delisting decision

U.S. Dataworks Inc. faces being delisted from the NYSE Amex LLC exchange.

On Feb. 23, the Sugar Land-based maker of payment processing software was notified by Amex that its listing would be struck from the exchange.

U.S. Dataworks (AMEX: UDW) was first notified of noncompliance related to stockholder equity and losses from continued operations on July 23, 2008. Since then, the firm performed a reverse stock split and submitted a plan of compliance to the exchange.

Amex granted U.S. Dataworks an extension to regain full listing compliance but as of Monday, the company had not yet regained compliance.

U.S. Dataworks said it will seek an oral hearing to fight the delisting. If it does not win, its stock will be quoted on the OTC Bulletin Board.
