Joan, You need to read your hypothecation agreement. Perhaps your broker
was saying that it would be unlikely, as your shares are from a pool of
shares available to short, and people cover every day. Certification would
affect those who wish to enter into a short trade first (sorry, none
available), then those with active short positions second. The owners of the
shares are the one's with the rights, not the ones who borrow to short.

If indeed Merril's hypothecation agreement is as you say, let me know,
I may steer all my short trades to them. :-)
