Not sure what bankruptcy has to do with it, but it is an asset of the company and is handled as such. It is hardly ever given away, as the claimants want to use the asset to generate revenues.

Wang had big problems with this issue and prevailed. All who had bought used Wang equipment had to pay up, shut it off, or risk punitive damages. There were a series of hotly contested cases, but all lost to Wang, even during and after bankruptcy, as I recall.
