Rutgers, One thing I have learned from dealing in several court cases is that victory come out of nowhere and defeat whacks you upside the head. I think their is too little information to make a judgement in pre-trial. What we need is an SI person to go and watch some of the trial.

The key comment from your post - First, Judges, particular Federal Judges, don't like it when parties do not embrace the discovery process in good faith. Second, notice that the Judge ordered "Infineon's lawyers be sent to the company's headquarters in Germany to make sure the company complies with his wishes.

Having been in several federal court rooms, this is a very true statement.
