A Georgia judge permanently blocked enforcement of the state’s ban on most abortions after six weeks of pregnancy, ruling that it was clearly unlawful at the time the state legislature passed it in 2019.

Judge Robert McBurney of the Superior Court of Fulton County noted Tuesday that there has been a sea change in abortion law because of the U.S. Supreme Court’s ruling in June that overturned Roe v. Wadeand ended federal constitutional protections for abortion. But the judge said that if Georgia wants to impose an abortion ban, the legislature would need to revisit the issue and pass a new law.
