For the same reason people rob banks: It is where the money is.

There are plenty of excellent doctors who have been sued for nothing. And in fact, where the patients have cashed out when the doctor did precisely as he/she should have.

As long as you have malpractice insurance companies which have to settle cases because the potential loss is insanely high, you will have attorneys who are glad to get involved and you will have defensive medicine.

Which is the reason no serious health care reform like ACA could conceivably have NOT addressed the tort reform proposition. No one who truly wanted to control the cost of care would consider ignoring what amounts to an estimated 25% of labs, referrals, and specialists fees.

Which makes ACA all the more ridiculous.
