I agree that there is something unsettling about Rev. Jackson making threats of civil unrest BEFORE the Court rules. Clearly, he wants to intimidate the Justices. Bad form.

I listened to the argument, and I know you did too, and one of the things I heard from Justice Breyer sort of tracks what I have been thinking all along. If it were possible, wouldn't it have been better, say, a month ago, to have a statewide recount in Florida with objective standards for counting votes?

But now we find ourselves only a week from the meeting of the Electoral College, and if Florida's Electors don't vote, then the entire state of Florida will be disenfranchised, causing the violation of the civil rights of all 6 million voters, not just those whose votes can only be discerned by a manual review.

Not to mention giving the election to Gore by default.
