Are you saying that they will get no interest on drugs developed on their patents for the genes that helped to produce the drug? Are you sure about that?Now ;if that's is true, what's to prevent them from producing more contracts where they do get an interest? From my standpoint, what you say does not make sense.

If you have the patent on a gene, then you license it out for a return. Maybe you are sharing the data, but you get something for it. That's the point of discovering it in the first place.
