A terrible article. But what you expect from Salon.

It takes several remarks out of context and totally spins them backward. And it seems lots of comments presented by the attorneys are taken as though they were from the justices.

The premise of that article is total bullshit. I listened to the entire argument before the Court which was replayed on C-SPAN radio this week. Practically all of the question posed by the justices were relevant and reasonable, and reflected a good understanding of the issues. As an example of the silliness of the article, there is this quote: "“I don’t want to admit it, but my wife might put a little note [with directions] in my pocket.” But in context, it was highly relevant to the question of where the line is drawn between searches of cell phone and finding a note in the pocket of a suspect.

As I listened to the arguments, I was astounded that the decision went the way it did -- all of the questioning pointed to the other outcome. But at the end of the day they made the correct decision.

He asked the lawyer, Seth Waxman, what the invention of eBay was, and when Waxman explained it as an electronic market, Chief Justice Roberts responded flippantly, saying, “I mean, it’s not like he invented the internal combustion engine or anything. It’s very vague.”

Do you disagree with this point? What IS the "invention" of eBay?

The writer of the article needs to do a little more research than merely extracting points from the transcript. It is one of the problems with today's media.
