Medinah Energy Inc. files lawsuit in Canada against Dayton Mining Corporation
LAKE ELSINORE, Calif.--(BUSINESS WIRE)--July 21, 1998--Medinah Energy Inc., a Nevada Corporation, Plaintiff, has filed a complaint against Dayton Mining Corporation [AMEX:DAY - news] in the Supreme Court of British Columbia, Canada, file No. c983657
The Plaintiff's claim is;
The Plaintiff owns (directly of indirectly) the rights to certain mining properties in the Andacollo District of the State of Chile, including the properties known as the Mercedes, Rodrigo, Toro, and Gabriella. The Plaintiff has also acquired from the registered claim holder, the right of first refusal to acquire certain other properties (known as the Marilola, Encarnacion, and Marijen) for which the rights are under dispute between the Defendant and the registered claim holders, in the event that the registered claim holders are successful in maintaining their claims.
In June and July of 1998, the Defendant published information in its 1997 Annual Report and in press releases alleging that the Defendant holds mineral titles and surface rights to all land which covers its published reserves, resources and mine plan at Andacollo. The Plaintiff's Rodrigo, Mercedes, Toro and Gabriella properties and the properties over which it has rights of first refusal, aforesaid, are all clearly inside the stated reserves, resources and mine plan of the Defendant.
The actions of the Defendant in falsely and maliciously publishing the aforesaid information, without lawful occasion or excuse, has brought into question the Plaintiff's ownership of the Chilean properties referred to above, and the plaintiff has suffered loss and damage thereby, including but not limited to, loss of ability and opportunities to arrange financing, and damage to its general reputation.
The Plaintiff claims:
a) General and special damages for defamation and slander of title;
b) An injunction restraining the Defendant and its agents from disputing the Plaintiff's rights to its Chilean mineral properties;
c) costs of this action;
d) Such further and other relief as this honorable court may deem just.

In a news release dated April 8, 1998, Medinah Energy inc. announced that the Company had authorized Legal Counsel for the Company in North America to begin proceedings against Dayton Mining Corporation. That lawsuit was registered in the State of Nevada on July 17, 1998, see news release dated July 20, 1998.
In a further update regarding the Churumata leased properties, Chilean Counsel for the Company stated that ''Dayton exceeded the order of access right over the Churumata plant. The order only permitted them to occupy the property and not to destroy the buildings. This is confirmed by a report made by the Judge who gave the order for access. There is still pending a resolution about this plus a criminal investigation against the people who personally acted for Dayton in the destruction of the buildings. ... Today one of the lawsuits, with which they (Dayton) tried to cancel the registration of Tornero's mother's claims, was not accepted by the courts. The judgment was given June 26, 1998 in Andacollo and refers to the properties Marijen 1 and 2.''
