Review of the International Search Report (ISR) prepared 13 March 2018 by the Canadian Intellectual Property Office (CIPO)
I have reviewed the International Search Report (ISR) prepared 13 March 2018 by the Canadian Intellectual Property Office (CIPO) out of the international (PCT) counterpart (PCT/IB2017/001457) to the US patent application (Ser. No. 15/795,145) and see that all claims are considered novel, but about half of them are found to lack inventive step (which means they are considered to be obvious over the cited prior art). Specifically, claims 1, 3-5, 9, and 13-17 are said to lack inventive step. Claims 2, 6-8, 10-12, and 18-20 have no prior art problems (according to the CIPO examiner), and claim 18 has only two very minor formal problems that can be readily corrected by amendment. The USPTO and most other major patent offices will conduct a further examination and are free to raise other rejections if they find additional prior art, but if prosecution of this one goes as it did for the Blade Optics patent, nothing else of significance will turn up. If that is the case, claims 2, 6-8, 10-12, and 18-20 will be allowed in the first Office Action (assuming the problems with claim 18 are corrected before then). For further clarification, the ISR serves as a starting point for the examiner in each country in which NXO enters examination of this patent application. NXO will have the opportunity in each country to disagree with the conclusions in the ISR, argue against rejections of any claims, and further amend the claims in attempts to get them in better condition for allowance.
