This is an assumption, not a fact. The matter hinges on the meaning of the phrase "and subject to the jurisdiction thereof" in the 14th Amendment and the truth is the SCOTUS has never ruled on whether birthright citizenship applies to a child born here of parents who are here illegally. In the most recent relevant ruling (in 1898), which many assume to confer birthright citizenship of children of illegals, Wong Kim Ark was the son of Chinese citizens who were legal, permanent residents of California. The question of illegal immigration never came up.
